حضور الاستاذ م.جمال شيخوني مالك شركة المرساة لتطوير المشاريع المؤتمر السنوي الثاني والعشرون حول القضاء وعلاقته بالتحكيم بدول مجلس التعاون الخليجي.
افتتح أمس بفندق منتجع كروان بلازا صلالة تحت رعاية معالي السيد محمد بن سلطان بن حمود البوسعيدي وزير الدولة ومحافظ ظفار، الملتقى السنوي الثاني والعشرون لمركز التحكيم التجاري بدول مجلس التعاون الخليج العربية بعنوان "القضاء وعلاقته بالتحكيم بدول مجلس التعاون الخليجي" ويستمر خلال الفترة من ١٥ وحتى ١٧ أغسطس. ويتحدث في المؤتمر نخبة من القضاة والمستشارين القانونيين والمحامين من دول مجلس التعاون.
وقال سعادة أحمد نجم الأمين العام لمركز التحكيم التجاري بدول مجلس التعاون الخليج العربية إن المؤتمر يتناول الدور الذي يؤديه القضاء التحكيم في دول مجلس التعاون الخليجي بإرساء قواعد العدالة سواء قبل بدء إجراءات التحكيم أو خلالها أو بعد صدور الحكم المهني للخصومة. وقد بات من المؤكد أنَّ اللجوء إلى الطريق القضائي كوسيلة وحيدة لحل المنازعات الخاصة الدولية صار شاقاً، ولا يتفق مع مقتضيات وحاجة التجارة الدولية، وهو ما قد نجد فيه تفسيراً مقبولاً لتعاظم دور التحكيم الذي هو أسلوب اتفاقي قانوني لحل النزاع بدلاً من اللجوء للقضاء، عن طريق هيئة تحكيم مشكلة من فرد أو عدد من الأفراد من المحكمين لا يمثلون السلطة القضائية للدولة للفصل في النزاع المحال للتحكيم.
وقال عبد الله الرواس رئيس غرفة تجارة وصناعة عُمان فرع محافظة ظفار في كلمته بالمؤتمر إن غرفة تجارة وصناعة عُمان بمحافظة ظفار تضع كل إمكانياتها في خدمة الأشقاء المشاركين من دول مجلس التعاون ونتمنى من القطاع العام والقطاع الخاص بدعم مثل هذه المؤتمرات ليتسنى لها الاستمرارية. وبما أن التحكيم أصبح الأسلوب السائد في التجارة الدولية ويساهم في نهضة الاقتصاد فقد أولته دول مجلس اهتماما خاصا. وبعد انتهاء الجلسة الأولى من المؤتمر كرم معالي السيد الوزير ورئيس الغرفة المتحدثين بالمؤتمر والرعاة.

Mr. Jamal Chaykhouni has been empanelled with the Kuala Lumpur Regional Center for Arbitration (KLRCA) as ADJUDICATOR
Adjudication:
The construction industry, in particular, the Construction Industry Development Board (CIDB) and Master Builders Association Malaysia (MBAM) and other related promoters have been instrumental in getting the government to enact this piece of legislation since 2003 to address the cash flow problems plagued by the industry.
The primary objective of the Act is to address cash flow problems in the construction industry.
It removes the pervasive and prevalent practice of conditional payment (‘pay when paid’, ‘pay if paid’ and ‘back to back’) and reduces payment default by establishing a cheaper and speedier system of dispute resolution in the form of adjudication.
The Act also provides for the recovery of payment upon the conclusion of the adjudication process in addition to a host of other remedies such as a right to reduce the rate of work progress or to suspend work or even to secure direct payment from the principal.
It further provides default payment terms in the absence of provisions to that effect in the construction contract.
