The PPWR and the PFAS limits are now in force. What should manufacturers prepare for next?

One topic that is heavily discussed is bisphenols, because they are a rather frequent contaminant in recycling streams. As the proportion of recycled content in material increase, the risk of materials containing higher amounts of bisphenols also increases.

The same applies also to mineral oil hydrocarbons.

So these will for sure be more regulated in the future, but the question remains whether they will be included into the PPWR or under other, separate regulations.

Our customers often ask: does the PPWR PFAS limit also apply to secondary food packages?

If the secondary packaging is an inherent part of the packaging, then yes, the PFAS and total fluorine limits apply. An example of this could be the outer cardboard box of a cereal package.

Does the PPWR mandate compostability testing for packaging materials?

It's important to distinguish between home compostability and industrial compostability, because they're separate but often get mixed up. The PPWR sets the baseline at industrial compostability, so that is the primary criterion.

The deadline is in early 2028, and it concerns only certain materials like tea bags, coffee filters, and sticky labels on fruit.

Additionally, member states can set further requirements for home compostability, but that goes beyond the general PPWR requirements.

What to do if your packaging material exceeds the 50 ppm total fluorine limit declared in the PPWR?

First and foremost, don't panic. Exceeding this limit does not yet mean that your packaging in non-cmpliant: it only means that some further investigations are needed.

There are many reasons why your material could contain fluorine without it being PFAS. For example, there are some fluorochemicals that are allowed, or your material could contain naturally occurring inorganic fluorides.

So the next steps are to check what could be the source of the fluorine, and then follow up with organic fluorine or targeted PFAS analyses to demonstrate that the material is indeed free of intentionally added PFAS.

How to test packaging materials for PFAS compliance?

Testing Expert Niko Markkinen explains: At the moment, the main requirement is to test for total fluorine.

Why? To prove that no PFAS have been intentionally used in the packaging.

If total fluorine is below the 50 ppm limit stated in the PPWR, it indicates that no PFAS compounds have been intentionally used, and no further testing is needed.

If the limit is exceeded, further investigations should be done, again with the aim of demonstrating that the fluorine does not originate from PFAS. First, you should analyze how much of the fluorine present is organic, and only if that too goes over 50 ppm is a targeted PFAS analysis needed.

Does the PPWR actually mandate PFAS testing, or can it be skipped?

This, again, depends on the intended use of the package. If it will be used for packing and transporting food, then yes, you need to be able to prove that it meets the criteria for PFAS and total fluorine.

What's important to note is that this can also apply for secondary food packagin, like cereal cardboard boxes, even though they are not in direct contact with the cereal.

If your packaging has nothing to do with food, then the PFAS limits do not apply 😌

The fine line of when a product is and isn't packaging according to the PPWR

Paper cups are, as Testing Expert Niko Markkinen explains below, a great example - they can be a package and they can be a product.

If they are used as packaging, for example for selling takeaway coffee, they need to comply with PPWR requirements.

If they are sold as the product on a supermarket shelf, they are not packaging.

Key deadlines of the PPWR 📦

The most important date was August 12, 2026, when the regulation came into force. This included the requirements for heavy metals and PFAS or total fluorine, which caused the most movement in the industry.

The next key milestones will be the introduction of the recyclability requirements in 2028, which should then come into force in 2030.

Clothes hangers and other surprising things considered packaging by the PPWR

Whatever is used to transport a product can be considered packaging - and thus needs to comply with the PPWR.

When people think about packaging, it's usually something like a box that you put something in. But in terms of PPWR, anything that is used to contain or transport a product or is an inherent part of the product can be considered packaging.

Some typically surprising examples are clothes hangers, sticky labels on fruits, and cake doilies.

But while these can be packaging, they are not always: if clothes hangers or cake doilies are sold in a store, they are the product itself and no longer packaging.

If your logo is on the packaging, you are the responsible one.

The question of who is responsible for compliance with the PPWR has caused headaches in the industry, mainly because the company manufacturing the packaging is not necessarily the one responsible.

According to the PPWR, it is the company presenting the packaging to the market that is responsible, the so-called concerned manufacturer.

To put it simply, like Niko Markkinen does in the video: "The one who holds the brand is considered the manufacturer, not the one who makes the packaging".
