A buyer of a land should take steps at conducting an official search at the Regional Lands Commission to ascertain the true owner of the land he seeks to buy. Where such a buyer fails to do that and proceeds to buy the land, a future litigation which arises from a third party’s interest in the land as a result of registration will go against him.

Always conduct an official search on a land before you proceed to buy.

It is required of every purchaser of a land to be innocent purchaser in the eyes of the law.

For the law to consider one as innocent purchaser, 3 tests must be passed by the buyer. The 3 tests are that the buyer should have had no Actual Notice, Constructive Notice and Imputed Notice of a third party’s interest in the property he/she seeks to buy.
