EXECUTIVE ORDER NO. 01 - Series of 2027

ESTABLISHING THE ANNUAL CAPACITY DEVELOPMENT, GOVERNMENT ASSISTANCE, AND COMMUNITY DEVELOPMENT PROGRAM OF THE PUROK 2 ALEGRIA SITIO SUPON VILLAGE SMALL SCALE MINERS ASSOCIATION (PASSMA)

WHEREAS, Republic Act No. 7076, otherwise known as the People's Small-Scale Mining Act of 1991, recognizes the role of small-scale mining in national development while promoting the responsible utilization and conservation of mineral resources;

WHEREAS, Republic Act No. 7942, otherwise known as the Philippine Mining Act of 1995, provides policies for the proper exploration, development, utilization, and conservation of the country's mineral resources while ensuring environmental protection;

WHEREAS, DENR Administrative Order No. 2022-03 provides the Revised Implementing Rules and Regulations of Republic Act No. 7076 and includes provisions for technical assistance, capability-building, mine safety, environmental protection, and institutional strengthening for qualified small-scale mining operations;

WHEREAS, DENR Administrative Order No. 2026-08 establishes guidelines governing Interim Small-Scale Mining Contracts (SSMCs) within declared Minahang Bayan areas and promotes lawful, responsible, and environmentally sound mining practices;

WHEREAS, PASSMA recognizes that responsible small-scale mining must contribute not only to mineral production but also to environmental conservation, community welfare, livelihood generation, infrastructure development, and food security.

NOW, THEREFORE,

The Purok 2 Alegria Sitio Supon Village Small Scale Miners Association (PASSMA) hereby adopts this Executive Order establishing the Annual Capacity Development, Government Assistance, and Community Development Program (ACDGCDP).

SECTION 1. DECLARATION OF POLICY

PASSMA shall promote responsible, safe, environmentally sound, transparent, and sustainable small-scale mining through continuous education, technical assistance, environmental stewardship, institutional development, and collaboration with national government agencies, local government units, indigenous communities, and other stakeholders.

SECTION 2. GENERAL OBJECTIVES

The Program shall:

1. Strengthen the technical competence of PASSMA members.
2. Promote compliance with mining, environmental, safety, and health laws.
3. Improve environmental management and mine rehabilitation.
4. Enhance productivity through appropriate technologies.
5. Develop sustainable livelihood opportunities.
6. Improve the quality of life of members and host communities.
7. Strengthen institutional partnerships with government agencies.

SECTION 3. CAPACITY DEVELOPMENT PROGRAM

PASSMA shall implement or request assistance for the following activities:

SECTION 4. GOVERNMENT ASSISTANCE PROGRAM

PASSMA shall seek technical and institutional assistance, subject to applicable laws and available government programs, from:

- DENR
- Mines and Geosciences Bureau (MGB)
- Provincial Mining Regulatory Board (PMRB)
- Department of Science and Technology (DOST)
- Technical Education and Skills Development Authority (TESDA)
- Department of Trade and Industry (DTI)
- Department of Labor and Employment (DOLE)
- Cooperative Development Authority (CDA)
- Department of Agriculture (DA)
- Bureau of Fisheries and Aquatic Resources (BFAR)
- Department of Public Works and Highways (DPWH)
- Local Government Units (LGUs)

SECTION 5. COMMUNITY DEVELOPMENT PROGRAM

PASSMA shall encourage and support community development initiatives through coordination with the appropriate government agencies, including:

Infrastructure

- Improvement of Farm-to-Market Roads (FMR), subject to the programs and funding of DPWH and the concerned LGUs.
- Construction or rehabilitation of access roads and drainage systems.
- Water supply and rural electrification projects.

Agriculture and Fisheries

- Community Fishpond Development.
- Fish Hatchery Development for fingerling production and aquaculture support, in coordination with BFAR and the concerned LGU.
- Sustainable agriculture, agroforestry, and tree-planting programs.

Livelihood and Social Development

- Skills training and livelihood assistance.
- Scholarship support, when available through partner agencies.
- Women's livelihood programs.
- Youth leadership and skills development.
- Community health and medical missions.
- Disaster preparedness and emergency response capability.

SECTION 6. IMPLEMENTATION

A Program Management Committee shall be created by the PASSMA Board of Directors to plan, implement, monitor, and evaluate the Program, prepare annual work plans, coordinate with partner agencies, and submit annual accomplishment reports.

SECTION 7. FUNDING

Program implementation shall be financed through PASSMA funds, membership contributions, grants, donations, and lawful assistance from government agencies and development partners, subject to applicable laws, accounting rules, and the availability of funds.

SECTION 8. MONITORING AND EVALUATION

The Committee shall conduct quarterly monitoring and annual evaluation based on:

- Number of trainings conducted;
- Number of members trained;
- Mine safety performance;
- Environmental compliance activities;
- Community development projects implemented;
- Technical assistance received; and
- Organizational performance.

SECTION 9. EFFECTIVITY

This Executive Order shall take effect immediately upon approval by the PASSMA Board of Directors and shall remain in force until amended or repealed by a subsequent Executive Order or Resolution of the Association.

We are pleased to share a positive development regarding our proposed Farm-to-Market Road (FMR) leading to the Proposed Minahang Bayan Area.

PASSMA extends its sincere appreciation to the Philippine Fisheries Development Authority (PFDA) for its prompt response to our request and for officially referring our proposal to the Bureau of Agricultural and Fisheries Engineering (BAFE), the appropriate agency responsible for the planning and implementation of Farm-to-Market Road projects.

This referral is an important step forward in our continuing efforts to improve road accessibility for our community. The proposed FMR is envisioned to benefit not only our responsible small-scale mining activities but also local farmers, residents, and nearby communities by providing safer and more efficient access to livelihood opportunities and essential services.

PASSMA remains fully committed to complying with all government requirements and coordinating closely with the concerned agencies to ensure the successful realization of this vital infrastructure project.

The Sitio Supon Village Small Scale Miners Association (PASSMA) extends its sincere gratitude to the Department of Environment and Natural Resources – Forest Management Bureau (DENR-FMB) for its prompt and official response to our request for inclusion under the Expanded National Greening Program (ENGP).

While our request could not yet be accommodated due to budget constraints and existing program priorities, we deeply appreciate the professionalism, transparency, and consideration shown by the DENR-FMB. We are also encouraged by their statement that PASSMA may be considered in future planning cycles, subject to funding availability and government approval.

LEGAL AND TECHNICAL OBSERVATIONS

Matapos ang masusing pagsusuri sa Area Status Map at sa opisyal na findings ng Mines and Geosciences Bureau (MGB), narito ang aming mga paunang legal at technical observations.

Political Jurisdiction:

Batay sa opisyal na records at Area Status verification, ang buong proposed Minahang Bayan ay matatagpuan sa loob ng political jurisdiction ng:

-Barangay Cambagang
-Municipality of Barobo
-Province of Surigao del Sur

Dahil dito, ang may tamang jurisdiction sa pagproseso ng petition ay ang:

1. Provincial Mining Regulatory Board (PMRB) – Surigao del Sur.

2. Ibig sabihin, ang lahat ng proceedings kaugnay ng application ay dapat dumaan sa PMRB Surigao del Sur bilang legally authorized regulatory body.

Overlap with Another Minahang Bayan Petition:

1. Napag-alaman din na ang proposed Minahang Bayan ay may partial overlap sa naunang petition ng:

- Layap-Layap Small-Scale Miners Association (LLSSMA).

Gayunman, nilinaw ng MGB na:

1. Ang petition ng LLSSMA ay ibinalik (returned) sa PMRB Agusan del Sur matapos matukoy na ang subject area ay nasa Surigao del Sur, hindi sa Agusan del Sur.

2. Hanggang 16 July 2026, hindi pa rin nakakapag-comply ang LLSSMA sa requirement na ilipat o i-refile ang kanilang petition sa tamang PMRB.

Meaning:

- Sa kasalukuyan, ang overlap ay tila procedural issue lamang at hindi pa isang ganap na legal conflict.

- Kung hindi maipaperfect o maipagpatuloy ng LLSSMA ang kanilang petition sa tamang jurisdiction, maaaring mawala rin ang naturang overlap.

- Kumusta ang Legal Personality ng Layap-Layap Small-Scale Miners Association (LLSSMA)?

- Isa pang legal issue na nararapat suriin ay ang legal personality ng Layap-Layap Small-Scale Miners Association (LLSSMA).

- Batay sa impormasyong nakalap, LLSSMA is not yet registered with the Department of Labor and Employment (DOLE) at wala pang naipapakitang Certificate of Registration bilang workers' association.

Kung mapapatunayan ito sa pamamagitan ng opisyal na certification mula sa DOLE, maaaring magkaroon ito ng epekto sa kanilang legal standing at sa kanilang kakayahang kumatawan bilang isang organisadong samahan. Ang mga workers' associations ay kinakailangang mairehistro upang magkaroon ng legal personality alinsunod sa mga umiiral na patakaran ng DOLE.

Legal Questions:

- Does LLSSMA possess sufficient legal personality to maintain or perfect its Minahang Bayan petition?

- Can an unregistered association validly pursue a Minahang Bayan application before the PMRB?

- If LLSSMA has not acquired a legal personality, what is the legal effect on its pending or previously filed petition?

- Can the procedural overlap relied upon by the MGB be sustained if the association itself has not yet established its legal capacity?

Preliminary Observation:

Kung mapapatunayan na LLSSMA remains unregistered with the DOLE, maaaring maging isa itong mahalagang legal issue na dapat resolbahin ng PMRB at MGB, lalo na kung ang kanilang petition ay hindi pa rin naipaperfect at naililipat sa tamang jurisdiction. Ang isyung ito ay dapat suportahan ng opisyal na DOLE Certification of Non-Registration upang magsilbing matibay na ebidensya sa anumang legal at administrative proceedings.

Mga Legal at Technical Issues na Dapat Pang Suriin:

Issue No. 1:

Tama ba ang naging interpretation ng MGB sa Section 7(b)(3) ng DAO No. 2022-03?

Isa sa pinakamahalagang legal issues ay kung tama bang itinuring ng MGB na ang mga Minahang Bayan ng BAMMOA at TADASSMA ay sumasakop na sa buong 162 hectares na pinapayagan sa ilalim ng Section 7(b)(3) ng DENR Administrative Order No. 2022-03.

Kailangan pang ma-verify ang sumusunod:

1. Tama ba ang computation ng kabuuang area?

2. Valid at existing pa ba ang approvals ng BAMMOA at TADASSMA?

3. Sakop ba talaga nila ang buong allowable area?

4. May natitira pa bang legally available area sa loob ng MPSA?

Issue No. 2:

Absolute Prohibition ba ang Section 7(b)(3)?

- Isa pang mahalagang legal question ay ang tamang interpretasyon ng Section 7(b)(3).

- Talagang ipinagbabawal ba nito ang panibagong Minahang Bayan petition, o kailangan lamang ng written consent ng MPSA holder (PGPI)?

- Kung ang batas ay nangangailangan lamang ng consent ng MPSA holder, nangangahulugan itong hindi absolute ang prohibition.

- Sa madaling salita, maaaring maging legal pa rin ang panibagong Minahang Bayan application kung magbibigay ng written consent ang MPSA holder.

Ito ang isa sa pinakamahalagang legal issues na kailangang malinawan.

Issue No. 3:

Ano ang mga Alternative Legal Remedies kung Tumanggi ang PGPI?

Kung hindi magbigay ng consent ang PGPI, hindi ibig sabihin ay wala nang legal na remedyo.

Maaaring pag-aralan ang mga sumusunod:

- Maaari bang kuwestiyunin ang applicability ng Section 7(b)(3) batay sa kasalukuyang legal at operational status ng MPSA?

- Maaari bang maging qualified ang proposed area sa ilalim ng ibang provisions ng DAO No. 2022-03?

- Mayroon bang portions ng area na legally available para sa declaration bilang Minahang Bayan?

- Nananatili bang valid at compliant ang MPSA sa lahat ng requirements ng batas at ng Mineral Production Sharing Agreement?

- May iba pa bang legal grounds upang maideklara ang bahagi ng area bilang Minahang Bayan nang hindi nalalabag ang existing mining rights?

Preliminary Conclusion:

Batay sa paunang pagsusuri, ang usapin ay hindi lamang tungkol sa political jurisdiction, kundi pati na rin sa tamang interpretasyon ng Section 7(b)(3) ng DENR Administrative Order No. 2022-03, ang legal status ng mga umiiral na Minahang Bayan, at ang lawak ng karapatan ng MPSA holder.

Dahil dito, kinakailangan ang isang comprehensive Legal and Technical Position Paper na magsasama ng legal research, technical analysis, documentary evidence, applicable laws, DENR issuances, MGB guidelines, at relevant jurisprudence upang matukoy kung may legal na batayan para sa pagpapatuloy ng proposed Minahang Bayan application. at

Kung ang Section 7(b)(3) ng DENR DAO No. 2022-03 ay nagtatakda na ang deklarasyon ng Minahang Bayan sa loob ng isang MPSA ay maaaring payagan sa pamamagitan ng written consent ng MPSA holder, maaaring isaalang-alang ng PASSMA ang paghingi ng naturang pahintulot mula sa (MPSA Holder).

Maaari itong idagdag bilang isang hiwalay na legal issue o rekomendasyon:

Possibility of Obtaining the Written Consent of the MPSA Holder:

Isa sa mga legal na opsyon na maaaring isaalang-alang ng Purok-2 Alegria Sitio Supon Village Small-Scale Miners Association (PASSMA) ay ang paghingi ng written consent mula sa MPSA holder.

Kung ang tamang interpretasyon ng Section 7(b)(3) ng DENR Administrative Order No. 2022-03 ay nangangailangan lamang ng pahintulot ng MPSA holder at hindi nagtatakda ng absolute prohibition, maaaring maging legal na batayan ang naturang consent upang maipagpatuloy ang aplikasyon ng PASSMA para sa deklarasyon ng Minahang Bayan.

Legal Considerations:

Does Section 7(b)(3) permit the declaration of another Minahang Bayan upon the written consent of the MPSA holder?

If yes, may PASSMA negotiate directly with PGPI for such consent?

Can the PMRB and MGB process the petition upon submission of the required written consent and compliance with other legal requirements?

Recommendation:

Bago magsagawa ng iba pang legal na hakbang, maaaring makipagpulong ang PASSMA sa PGPI upang tuklasin ang posibilidad ng isang Memorandum of Agreement (MOA) o Written Consent, na magpapahintulot sa deklarasyon ng Minahang Bayan sa loob ng bahagi ng MPSA area, alinsunod sa DENR DAO No. 2022-03 at iba pang umiiral na batas.

Kung magkakaroon ng written consent mula sa MPSA holder at makukumpleto ang iba pang requirements ng batas, maaari itong maging isa sa pinakamalakas na legal na batayan para sa pagpapatuloy ng aplikasyon ng PASSMA.

Understanding the Legal and Technical Process for the Declaration of a Minahang Bayan:

The Purok 2 Alegra, Sitio Supon Village Small-Scale Miners Association (PASSMA) remains committed to promoting responsible, transparent, sustainable, and law-abiding small-scale mining. As part of our commitment to public awareness, we would like to educate our members, stakeholders, and the general public on the legal and technical requirements governing the declaration of a Minahang Bayan under Philippine mining laws.

Why is a Legal and Technical Evaluation Necessary?

The declaration of a Minahang Bayan is not automatic. Every petition must undergo a comprehensive legal and technical evaluation to ensure compliance with:

1. Article XII, Section 2 of the 1987 Philippine Constitution

2. Republic Act No. 7076 (People's Small-Scale Mining Act of 1991)

3. Republic Act No. 7942 (Philippine Mining Act of 1995)

4. DENR Administrative Order No. 2022-03

Other applicable policies, rules, and regulations of the Mines and Geosciences Bureau (MGB) and the Provincial Mining Regulatory Board (PMRB).

Legal and Technical Matters that Require Verification:

Before any proposed area may be declared as a Minahang Bayan, the PMRB, with the technical assistance of the MGB Regional Office, should first conduct the necessary legal and technical evaluation, including:

✅ Official Area Status Verification to determine whether the proposed area overlaps existing mining rights, pending mining applications, government reservations, protected areas, or other legal restrictions.

✅ Verification of the legal status of the existing mining tenement, including whether it remains valid, has expired, has been relinquished, suspended, cancelled, or otherwise terminated.

✅ Verification of whether the subject mining area qualifies as an "inactive mining area" under Section 7(c) of DENR Administrative Order No. 2022-03, based on official MGB records and field verification.

✅ Determination of the applicability of Section 7(d) of DENR Administrative Order No. 2022-03, considering that the majority of the proposed Minahang Bayan consists of privately titled properties, including the identification of the legal rights, conditions, and limitations applicable to such private lands.

✅ Verification of private titled properties, ownership records, and compliance with applicable laws protecting vested property rights.

✅ Preparation of official overlay maps using NAMRIA, MGB, and Land Management Bureau (LMB) datasets to accurately determine overlapping mining rights, land classifications, and cadastral boundaries.

✅ Verification of possible overlaps with ancestral domains, protected areas, government reservations, and other environmentally or legally restricted areas, where applicable.

✅ Submission of a technical report on mineralization and confirmation that the proposed area complies with the area limitations and technical requirements prescribed under DENR Administrative Order No. 2022-03.

Existing Mining Tenements and Private Lands:

It is important to understand that the mere absence of mining operations for several years does not automatically terminate an existing mining right. The legal status of any mining tenement must first be officially determined by the MGB Regional Office based on its records and applicable mining laws.

Likewise, the presence of private titled properties does not automatically disqualify an area from being considered for declaration as a Minahang Bayan. Section 7(d) of DENR Administrative Order No. 2022-03 recognizes that private lands may, under certain conditions and subject to existing rights and legal limitations, be considered in the evaluation process.

Consent of the Existing Mining Right Holder:

If, after verification, the mining tenement is determined to remain legally valid, the PMRB may evaluate whether it would be appropriate to facilitate or recommend obtaining the written consent, conformity, waiver, or certification of no objection from Philex Mining Corporation, if such action is legally necessary or would facilitate the orderly processing of the petition and help avoid future legal disputes.

Commitment to Responsible Mining:

Only after the completion of all required legal and technical verifications may the PMRB properly evaluate whether the proposed area is legally qualified for declaration as a Minahang Bayan in accordance with Republic Act No. 7076, Republic Act No. 7942, and DENR Administrative Order No. 2022-03.

PASSMA firmly believes that responsible small-scale mining begins with compliance with the law, respect for property rights, sound technical evaluation, environmental stewardship, transparency, and due process. Through cooperation among communities, government agencies, and legitimate stakeholders, we can promote a mining industry that is lawful, sustainable, and beneficial to present and future generations.

This Public Advisory is intended solely for educational and informational purposes to promote public understanding of the legal and technical processes governing the declaration of a Minahang Bayan. Final determinations remain within the authority of the Mines and Geosciences Bureau (MGB), the Provincial Mining Regulatory Board (PMRB), the DENR, and other competent government agencies based on official records, technical findings, and applicable laws.

Barangay Officials, Community Leaders, and Residents of Barangay Alegria, San Francisco, Agusan del Sur

We wish to inform the public that an Extract Blotter has been officially issued by the San Francisco Municipal Police Station regarding a reported incident involving the alleged sighting of three (3) armed individuals in the vicinity of the PASSMA Office in Purok 2, Sitio Supon, Barangay Alegria.

The issuance of an Extract Blotter signifies that a report was formally received and entered into the police blotter. However, it is important to emphasize that a blotter entry merely records a reported incident and does not, by itself, establish that the reported allegations have been proven or that any person is legally responsible. Any determination of criminal liability remains subject to proper investigation and due process.

In view of the seriousness of the reported incident, we respectfully call upon the following agencies to undertake the appropriate actions within their respective mandates:

Philippine National Police (PNP) – to conduct a thorough, impartial, and evidence-based investigation to determine the facts and identify any persons who may be responsible, if warranted by the evidence.

Barangay Officials – to assist in maintaining peace and order within the community and to cooperate with law enforcement authorities.

Mines and Geosciences Bureau (MGB), Provincial Mining Regulatory Board (PMRB), and other concerned government agencies – to continue performing their respective functions independently and without influence from any reported incident, ensuring that all official actions remain based on applicable laws, regulations, and verified facts.

We likewise encourage anyone who may have relevant information regarding the reported incident to cooperate with the proper authorities through lawful channels.

At the same time, we respectfully urge the public to refrain from speculation, spreading unverified information, or prematurely concluding that any individual or group is responsible unless supported by competent evidence and the findings of the proper authorities.

The safety of every member of the community is a shared responsibility. We remain hopeful that the matter will be resolved through a fair, impartial, and lawful investigation consistent with the principles of due process, the 1987 Philippine Constitution, and the rule of law.

Warm greetings.

We respectfully submit this public notice as a constructive request in the interest of due process, transparency, fairness, and accountability in the conduct of barangay proceedings.

It has come to our attention that the Invitation issued by the Barangay does not clearly state the nature, purpose, or specific allegations of the complaint. Out of respect for the constitutional right to due process, we respectfully request that future invitations clearly indicate the purpose of the summons and the issues to be discussed so that respondents may adequately prepare, gather relevant documents and evidence, and be properly represented during the proceedings.

This request is consistent with the principles embodied in:

1. Article III, Section 1 of the 1987 Philippine Constitution, which guarantees that no person shall be deprived of life, liberty, or property without due process of law.

2. Republic Act No. 7160 (Local Government Code of 1991), particularly the provisions on the Katarungang Pambarangay, which promote fair, impartial, and orderly settlement of disputes at the barangay level.

3. Republic Act No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees), which requires public officials to perform their duties with professionalism, transparency, responsiveness, and accountability.

We likewise respectfully request clarification regarding the legal personality of the complainant if the complaint is being filed on behalf of an organization, association, or group, and not merely in an individual capacity.

This request is not intended to obstruct or delay the barangay proceedings. Rather, it seeks to ensure that all parties are afforded equal protection of the law and that the proceedings are conducted in accordance with the principles of fairness, transparency, and due process.

We firmly believe that a transparent and legally compliant process strengthens public confidence in the Barangay Justice System and promotes the peaceful resolution of disputes within our community.

We respectfully trust in the wisdom and impartiality of the Honorable Punong Barangay and the Lupon Tagapamayapa in ensuring that all proceedings are conducted fairly, lawfully, and with full respect for the rights of every party.
