Regulation Update: On July 1, 2026, EPA announced the proposed scope and analyte list for the Unregulated Contaminant Monitoring Rule (UCMR) 6, with sampling scheduled for 2028 to 2030. Once again, PFAS have made the list with the focus on “ultrashort organofluorine compounds”. While some of these organofluorine compounds are not considered PFAS under some technical definitions, they are commonly referred to as ultrashort-chain PFAS. The proposed monitoring program for UCMR6 includes the same expanded list of water systems as compared to UCMR5, resulting in an increase from approximately 5,000 systems sampled for UCMR4 to more than 10,000 systems sampled for UCMR5 and proposed for UCMR6. Public comments are open until August 31, 2026.

Regulation Update: NYSDEC Proposes Sweeping Changes to Landfill Leachate Treatment Requirements: What Landfill Owners and Operators Need to Know

New York State has proposed significant changes to how landfill leachate must be managed. The NYSDEC’s proposed amendments to 6 NYCRR Part 360 and Part 363 would require active MSW and C&D landfills to treat leachate before discharge, with a 99.9% removal standard for certain contaminants, including PFAS and 1,4-dioxane.

Our team has reviewed the proposed rules and sees important technical and practical questions that deserve attention before these regulations are finalized, including questions about the basis for the removal standard, clarity on target compounds, and the real-world feasibility of treating 1,4-dioxane to the same threshold as recalcitrant PFAS.

The public comment period closes September 9, 2026. Landfill owners and operators: your voice matters in this process.
