In August 2005, the IRS issued a notice under the Energy Policy Act of 2005, enacting 179D of the code, which provides a deduction with respect to energy efficient commercial buildings. This applied to property placed in service after January 1, 2006 but before January 2008. The Tax Relief and Health Care Act of 2006, in December 2006, extended the 179D to apply to property placed in service before January 1, 2009. The Emergency Economic Stimulation Act of 2008, in October 2008, further extended 179D deduction to apply to property placed in service before January 1, 2014. Section 179D allows a tax deduction to a tax payer for part or all of the cost of energy efficient commercial building property that the taxpayer places in service.
