IPART Clarifies New role in Transition for NSW Embedded Networks

Embedded Network stakeholders in NSW have been closely following IPART's planned approach to implementing new rules and powers afforded to them under the NSW Government's Embedded Network Action Plan.

IPART's new functions will commence 1 July 2026, however they have clarified that new maximum prices and billing standards will not be in effect by or on 1 July.

Their statement has advised that they will aim to give stakeholders reasonable notice prior to any new pricing obligations and billing standard.

Recently, the Australian Energy Market Commission (AEMC) released their 2026 draft life support rule changes, with implications for energy retailers and embedded networks.

The draft rule proposes retailers take a more active role and ownership of life support registration and de-registration, including a standardised medical confirmation form, and annual contact obligations to keep customer details accurate.

Customers would also be able to choose how they are contacted about planned outages and nominate an emergency contact person.

For embedded networks, the draft includes a requirement for retailers to inform the Embedded Network Manager, or embedded network operators in their absence, when a relevant customer registers for life support, improving visibility of protections within private networks.

The AER has released its draft Default Market Offer for 2026–27, introducing a new pricing framework, tariff‑level caps, and the new Solar Sharer Offer with free daytime electricity. Overall DMO prices are expected to fall across NSW, SE Queensland and SA from 1 July.

Regulatory Change for Embedded Networks in NSW

From 1 July 2026 new laws will give the NSW Independent Pricing and Regulatory Tribunal (IPART) stronger powers over embedded networks in apartments, retirement villages and shopping centres.

What does that mean?
✅ New Price caps for energy, hot water and
air-conditioning services
✅ New enforcement powers for IPART
✅ Embedded network operators must join and comply with an energy ombudsman scheme
✅ Significant Fines for operators found to be non-compliant.

2026 is set to redefine how consumer energy resources (CER) are measured, settled, and traded.

⚡ Households and small businesses using Secondary Settlement Points (SSP) will see tailored retail products, better orchestration signals, or more accurate attribution of CER value to customers or aggregators. All without introducing multiple retailers at a single premises.

⚡ Aggregators and asset owners through SSPs will realise cleaner access to CER value streams, improved product design, and far less friction in measurement and settlement.
