With the recent restructuring of the Victorian Building Authority (VBA) now incorporating Domestic Building Dispute Resolution Victoria (DBDRV) and the Victorian Managed Insurance Authority (VMIA) there is hope that the process for both builders and clients will become more streamlined, efficient, and transparent.

Prior to the VBA's formation in 2013, its predecessor was the Building Commission, which operated a dedicated service called Building Advocacy and Conciliation Victoria (BACV). BACV played a crucial role in early dispute resolution by arranging onsite meetings between builders and owners. These sessions aimed to resolve disputes before escalating to VCAT, saving both time and legal costs.

During these conciliations, both parties had the opportunity to present their views, after which an independent, qualified building inspector would assess the issues and provide a verbal, unbiased opinion. An experienced conciliator facilitated the discussion to help both sides reach a fair and reasonable resolution.

From a builder’s perspective, even if you didn’t fully agree with the assessment, it was often wise to accept the outcome and avoid the lengthy and costly VCAT process.
