If you are developing a property in Spain, this is an acronym you need to know!

The First Occupation License (LPO) is an official certificate granted by the local Town Hall (Ayuntamiento) once your build is finished. It legally verifies that the property has been built exactly according to the approved architectural plans and licence issued by them complies with the necessary health and safety regulations affecting dwellings.

Why does it matter? Without an LPO, you cannot register, nor legally live in your new villa, and you won't be able to connect the permanent water and electricity meters in your name!

Previously a lot of rural properties did not get this when they were first built. This is causing serious issues for anyone trying to sell, or legalise the properties now.

It is tempting to hand over control to your builder or main contractor and trust that they will select the right people to do the specialist jobs such as kitchen and bathroom suppliers and landscaping, but do you know why they are being chosen?

Often a contractor will choose a supplier who gives them a discount or commission, or someone they’ve worked with a lot, because it’s more convenient for them, rather than because they are the best people/products for your project.

Now it can also be that a contractor chooses the team that they know they can rely on to deliver. But it makes little sense to hand the builder more profitable income for simply making a recommendation, when that process should be properly specified, tightly contracted and professionally managed to ensure you don’t pay top dollar for poor quality or absence of guarantees!

You need to make sure that every supplier or tradesman that comes onto your site has been carefully selected and vetted to ensure you’re paying the best price and have the most skilled team. This is part of a well-managed tendering process and should not be skipped to save time or hassle.

It’s rare that we see positive impacts of war, but we were interested to see this article in Spanish Property Insight, suggesting that the current conflict in the Gulf could benefit Spain. We’re often asked the difference between Project Management and Project Development, so we wanted to explain that in today’s post.

Project Development Services are a much wider scope than Project Management alone. We become a single point of contact for the project and take responsibility and control for all aspects of it, becoming the Clients’ Development Departments.

This means that we will be empowered by the client to select and contract the right architect, technical architect, constructor and any other suppliers needed, such as FF&E, lighting, AV and Domotics, landscaping and irrigation and manage all the distinct suppliers, all for a singular contract and guaranteed price.

It is an ideal service for those Clients who are based abroad and don’t want to have the stress and time requirements of managing, paying and administering the key players. They leave it all to us to handle on their behalf.

All they have to do is pay the required amounts agreed in their contract with us and we do the rest - including getting the necessary invoices to their accountants. Simple.

Most recently we provided this integrated service to a Client from Dubai who wanted his Villa to be developed in La Cala Golf Resort, but as he ran his own very successful business there could not spend the time. His villa was developed and delivered on time and on the budget agreed at the outset, despite the Covid19 pandemic.

Before making decisions to save money as part of your project, you need to understand its impact on your development strategy.

Remember that if you are developing to make money, you need sales and those sales require cast iron delivery dates to produce your profits and pay off your bank/shareholder loans.

For example, you may want to source tiles from China to improve profit margins, but the impacts could be very detrimental. For example, if you have signed a fixed price contract, the builder will ask for a compensation to cover the loss he’ll incur from sourcing the tiles.

You will damage your cashflow as these materials will have to be paid for upfront, whereas the builder will only charge you what he has actually laid, after he lays them. If you have financed the works through a bank or funding entity, you will also unbalance this agreement. They will only finance the work and materials included in your fixed priced contract and approved by the Technical Direction Team, so you may well end up paying for the materials out of your own pocket!

You risk delaying the works if you do not receive the materials on time and could empower the builder to ask for compensation for carrying extra costs over a longer period than initially agreed. You could also be faced with additional storage charges if the materials should be available earlier than planned.

So, unless you are an expert in the logistics of construction, or delivery dates are not important to you, be very careful about intervening.

An analysis by BBVA Research indicates that electricity infrastructure constraints are affecting housing development in 31 Spanish provinces, including key urban areas such as Madrid and Valencia.

We’re seeing this more and more frequently in projects and unfortunately, dealing with the Utility suppliers is not a productive experience. Many existing systems in urban areas are now saturated, thus requiring new transformer stations to be implemented costing several hundreds of thousands extra.

It is one thing to be developing in a new area where the infrastructure has recently been installed ready to connect and quite another developing in a saturated area. Sadly, this is becoming more common and requires deep pockets to resolve.

Always ensure you do your technical due diligence before committing to develop a project within assumed timescales, as to deliver substantially over your deadlines harms profits and reputation!
