EVANS, THE LAW AND THE IGNORANCE OF NIGERIANS
After Evans was arrested, the police were busy feasting and taking selfie with him while Nigerians on the social media were busy trying and sentencing him.
As the drama was going on, Evans went to court to challenge his detention without court trials and how he is being treated by the police .
The social media went agog with condemnation and judgment. Nigerians said: how dare Evans went to court to file a suit against the police. They queried his guts and right to do so. His lawyer was castigated for wanting to defend a criminal .
Is Evans actually a criminal? In the eye of the law, Evans is guiltless. The law says that even if someone is caught red handed while committing a crime, he is not guilty until a court of competent jurisdiction says so. Sometimes, until the Supreme court has confirmed it that the person is guilty .
Despite the crimes that Evans was alleged to have committed, the constitution still guarantee his fundamental human rights. The law frowns at every form of inhuman treatment of a suspect. So , Evans has the right to challenge his arrest and detention by the police. It's left for the judges to condemn him.
The truth is that our laws are designed to favour the rich and the great and sometimes criminals. It these weaknesses that Lawyers explore in favour of their clients. It is therefore, our weak constitution that is to blame and not the lawyer.
Instead of the police to concentrate on thorough investigation and proper prosecution , they were busy celebrating and taking selfie with Evans.
The reason the federal government has been losing many cases, particularly corruption cases, is not because the suspects were not guilty but because the prosecutors could not gather enough evidence and prove their cases beyond reasonable doubts.
Media and police trial is no trial. It is time the police took Evans case from the court of the public opinion and prepared for the court of law for trials.
