Discrimination in the Real Estate Sector

After many years of working from home as a self-employed professional, I decided to expand my business activities and rent an office space. In December 2019, just before COVID-19 hit the Netherlands, I secured an office a few kilometers from my residence. What followed was a deeply unsettling experience that revealed systemic inequities in the real estate sector.

From the start, there were red flags. After completing the initial steps of the rental process and being invited to view the office space, I was unexpectedly told to attend an additional interview with one of their agents. This was unusual because I had already undergone a similar interview before receiving the viewing invitation. What made matters worse was that this interview required me to travel to their headquarters in Barendrecht, Rotterdam—a significant distance from my residence in Amsterdam.

When I arrived at their office, the agents appeared confused. There was no record of my appointment, and even if such an interview were necessary, it should have taken place at their Haarlem office, just minutes from Amsterdam. This irregularity was disconcerting, but I overlooked it, as I needed the space urgently.

After signing the rental agreement, I noticed I was charged a much higher advance payment than advertised. When I confronted the real estate office, their response was unsatisfactory, but I proceeded with the lease, focusing on using the space to grow my business.

Revealing a Pattern of Discrimination
A year or two later, the office building began to fill up with new tenants, predominantly Dutch natives. Among the exceptions was Jeremy, a Black Dutch citizen of Afro-Caribbean descent. Jeremy and I eventually connected over a shared concern: he, too, had been charged three times the usual advance payment.

This prompted us to investigate. We discreetly reached out to other tenants—all Dutch natives—and discovered they had not been subjected to the inflated charges. Only Jeremy and I, the two Black tenants, had been required to pay this excessive advance.

This revelation was deeply disturbing. When I formally complained to the real estate company, instead of addressing the issue, they retaliated. I began receiving emails accusing me of vague complaints from other tenants. Shortly thereafter, they installed a surveillance camera in the public hallway, a decision Jeremy and I protested as a breach of privacy. Many of our clients did not wish to be recorded without consent, but our objections were ignored.

Seeking Legal Action

Faced with blatant discrimination and retaliatory actions, I sought legal counsel. Below is a copy of the formal complaint my lawyers issued regarding this matter. I will also share the real estate company's response shortly to provide a full account of this case.

My experience with Villex Vastgoedbescherming, now operating under the name Gapph (Gapph aanbod), was far more than a case of rental inequities—it became the foundation of an ongoing struggle involving systemic racial discrimination and even encounters with law enforcement.

As previously detailed, I discovered that both I and another Black tenant, Jeremy, were charged three times the standard advance payment for our office spaces compared to our Dutch-native counterparts. When we raised formal complaints about this disparity, rather than addressing the issue, the real estate company retaliated.

Emails accusing me of vague complaints from other tenants began arriving in my inbox, creating an increasingly hostile environment. This escalated further with the sudden installation of a surveillance camera in the public hallway, raising significant privacy concerns for Jeremy, myself, and our clients. Despite our objections, these issues were dismissed, leaving us feeling marginalized and targeted.

Connections to Police Incidents

Unfortunately, the story didn’t end there. On May 11, June 21, and September 4, 2023, separate incidents occurred at the premises, and nearby location involving the Amsterdam Police. These events resulted in my arrest under circumstances that I believe involved the unreasonable use of force.

The connection between the real estate company's actions and the police incidents remains a source of deep concern. While the details of these encounters are being addressed through a formal complaint filed against the Amsterdam Police, it is clear that my experience as a tenant at Villex/Gapph is part of a broader narrative of racial bias and systemic discrimination.

Seeking Justice
------------------------
I have taken legal steps to address the discrimination faced during my tenancy and the troubling interactions with law enforcement. The documentation of these incidents, including correspondence with Villex/Gapph and the police, is critical in exposing these injustices.

Discrimination in the real estate sector is unacceptable, and the subsequent escalation to police involvement underscores the importance of standing up against systemic bias. I am committed to pursuing accountability, both for myself and for others who may have experienced similar treatment.

This story is not over. I will be sharing further details, including the formal response from Villex/Gapph and updates on the complaint filed against the Amsterdam Police. My goal is to shed light on these incidents, encourage dialogue, and advocate for fairness and justice. - Justice4G

Anti-Kraak Hotel / Pop-up Hotel Amsterdam

The Anti-Kraak Hotel, later known as Pop-up Hotel Amsterdam, was a forward-thinking project initiated by Mr. G Sam-Korsah and his research group/team ''REAL ESTATE HEROES'' (R.E.H) to address squatting issues in Amsterdam. Focused on creating legal anti-squatting ("anti-kraak") solutions, the team combined expertise in civil engineering, real estate, and IT, bridging skills from diverse backgrounds—Ghana, Pakistan, and Lebanon/Syria.

With the Amsterdam Institute for Advanced Metropolitan Solutions facilitating collaboration across sectors, the project leveraged Amsterdam’s European Capital of Innovation 2016 funding. This iCapital funding supported workshops, initiatives, and partnerships designed to solve complex urban challenges. The Anti-Kraak Hotel aimed to offer temporary, flexible housing solutions, with a specific focus on legal frameworks and practicality in urban environments.

Initially operated by GINO XXL SERVICES & Co. from 2016 to 2018, the Pop-up Hotel represented a modern approach to mitigating property vacancy and the related issue of squatting by allowing temporary residential or business use of unused buildings.

A recent anti-squatting incident in Amsterdam occurred when squatters occupied buildings in central locations like Rokin and Gravenstraat. Some of these squats are notable due to their complex legal and social implications. For instance, at Rokin, squatters commemorated a year of occupation with a celebratory event before police ultimately cleared the building. Another high-profile case involved Vossiusstraat 16, previously tied to a Russian oligarch; after the EU lifted sanctions on the owner, legal pressures mounted for the squatters to vacate the property​

Squatting, which was once semi-tolerated as a response to housing shortages, now faces stricter enforcement. Police have recently used force in several evictions, and many legal battles over squatted properties are ongoing. Sam-Korsah, founder of Gino XXL Enterprises Europe, they finally acknowledged a series of grievances that had been ignored for nearly a decade. This acknowledgement comes after repeated complaints made by Mr. Sam-Korsah since 2012, following the official establishment of his business.

Gino XXL Enterprises Europe, which became official in March 2012 after years of underground operation and development, encountered its first tax-related issues shortly after submitting its inaugural annual tax return in 2013. Despite years of filing all necessary tax returns—including quarterly turnover taxes (OB), annual income taxes (IB), healthcare allowances (ZT), and rental allowances (HT)—Mr. Sam-Korsah never received any tax refunds or payments from the Tax Office. Instead, all funds were withheld to cover an alleged debt, without substantial explanation or evidence. Despite these setbacks, he continued to fulfill his tax obligations and filed consistently.

Escalation and Harassment: January 2021- onwards

After nearly a decade of unanswered appeals, Mr. Sam-Korsah took his case to the National Ombudsman in 2021-2022, spurred by escalated harassment from the Tax Authorities. This harassment intensified following his complaints about a client, Robert Quack Holding BV, which had withheld payments for completed services for over three years. Additional grievances also arose around this time with other institutions, including alleged discrimination by Lufthansa and denial letters from government agencies, municipalities, and ventures, each citing various technicalities.

Notable Incident: 2021

Among these experiences, one incident particularly stands out: in 2021, Mr. Sam-Korsah received a fraud fine ("fraude boete") for a healthcare allowance (ZT) that he had never applied for. Astonishingly, someone had applied for this allowance in his name, used a different bank account, and received monthly payments directly from the Dutch Tax Office. This act raised significant questions regarding the security and transparency of the system.
