In the **National Building Code of the Philippines (NBCP) (PD 1096)**, copyright rules related to architectural works are not explicitly detailed, but intellectual property rights for architects are covered under **RA 9266 (The Architecture Act of 2004)** and **RA 8293 (The Intellectual Property Code of the Philippines).**

# # # # **1. Ownership of Architectural Plans & Designs**
- **RA 9266, Section 20** states that an architect **owns the copyright** to his architectural documents, including drawings, plans, and designs, unless there is a written agreement transferring the rights to another party.
- The **client has the right to use** the plans for the intended project but **cannot reuse, modify, or replicate** them without the architect’s consent.

# # # # **2. Protection of Architectural Works**
- Under **RA 8293 (Intellectual Property Code)**, architectural designs and buildings are protected as **original works**.
- Unauthorized reproduction, alteration, or adaptation of an architect’s work is **considered copyright infringement**.

# # # # **3. Unauthorized Use & Legal Consequences**
- Only **registered and licensed architects** can prepare, sign, and seal architectural plans under the **NBCP and RA 9266**.
- Unauthorized reproduction or use of an architect’s work **without permission** may result in legal action, including fines and imprisonment.

# # # # **4. When Copyright Expires**
- Under **RA 8293**, the copyright for an architectural work lasts **during the architect’s lifetime plus 50 years** after their death.

# # # # **5. Ethical and Professional Responsibilities**
- The **Code of Ethical Conduct for Architects** (IRR of RA 9266) states that architects must respect other professionals' copyrighted works and avoid plagiarism.
