The Federal Tax Ombudsman (FTO) has directed the Karachi Large Taxpayer Office (LTO) to refund extra paid sales tax on vehicles to the Bank of Punjab (BOP) in order to provide tax relief to end customers.
In this regard, the FTO issued an order (Informal Resolution of Disputes) against Pak Suzuki Motor Company Limited on Thursday.
According to an FTO order, the BOP filed the complaints under Section 33 of the Federal Tax Ombudsman Ordinance, 2000 (FTO Ordinance), along with a copy of the NOC from the complainant/buyers of the cars through a bank lease.
The bank filed complaints on behalf of the buyers, seeking relief from the charging of a higher rate of sales tax on these cars purchased by the complainant from the aforementioned car manufacturer.
In brief, the bank booked these vehicles when the sales tax rate was 17 percent. Meanwhile, the sales tax on cars up to 1000CC was reduced to 12.5 percent, and federal excise duty (FED) was eliminated as part of the Finance Act 2021, which went into effect on July 1, 2021.
Despite the fact that the company waived FED, it charged sales tax at the rate of 17 percent at the time of booking rather than the invoice/delivery date, depriving the complainant of the reduced tax burden. The bank has now filed an application on behalf of the buyers to refund the difference in sales tax based on the rate in effect on the date of delivery of the vehicle.
According to FTO, all of these cases are currently being implemented in Karachi. The FTO's regional office in Karachi has devised an effective implementation strategy in collaboration with the LTO Karachi and the car company. Because this is a 100% parallel case, no further investigation is necessary because the petitioner is entitled to the relief sought and granted by the competent authority in other similar cases.
In light of the foregoing, the LTO Karachi is directed to grant relief to the bank in accordance with the referred cases upon submission of an undertaking to the LTO Karachi that the benefit of the refund of extra paid sales tax will be shared with the end customers/clients, according to the FTO order.
