Tax Rates on Property Transactions
For Tax Year 2024

The tax rates on property transactions, encompassing both sale and purchase, have been officially announced for the tax year 2024 in Pakistan.

The updated tax rates mandate that individuals engaging in immovable property transactions are required to pay withholding tax at the time of the transaction.

The tax rates are differentiated for individuals listed in the Active Taxpayers List (ATL) and those not on the ATL. According to the official rate chart for the tax year 2024, the following withholding tax rates apply:

For Sellers of Immovable Property:

• Individuals in the ATL: Three percent of the consideration received.

• Individuals not in the ATL: Six percent of the consideration received.

For Buyers of Immovable Property:

• Individuals in the ATL: Three percent of the transaction amount.

• Individuals not in the ATL: 10.5 percent of the transaction amount.

This means that a seller of immovable property in Pakistan, if listed in the Active Taxpayers List, is obligated to pay a withholding tax of three percent of the consideration received. However, if the seller is not an active taxpayer, the withholding tax rate increases to six percent.

Similarly, a person purchasing immovable property in Pakistan, provided they are an active taxpayer, is subject to a three percent withholding tax. On the other hand, if the buyer is not on the Active Taxpayers List, the withholding tax rate is elevated to 10.5 percent of the transaction amount.

These tax measures aim to encourage tax compliance among property transactions and contribute to the documentation of the real estate sector. The distinction in tax rates based on taxpayer status underscores the government’s commitment to incentivize individuals to become active taxpayers.

Property owners, buyers, and sellers are advised to familiarize themselves with these updated tax rates to ensure compliance with the law. The government continues to focus on reforms that foster a transparent and accountable tax system, promoting economic growth and fiscal responsibility.

Property Tax is levied and collection under Sindh Urban Immovable Property Tax Act, 1958. A uniform rate of tax is levied on all categories of properties @ 25% of annual rental value (ARV).w.e.from 01.07.2013.

Brief of Property Tax:
1- The Property Tax is levied and collected under the Sindh Urban Immovable Property Tax Act, 1958 and Rules framed there under. The Property Tax is levied under Section 3 of the above said Act, by estimating gross annual rent, which is determined under Section 5 of the Act.

2- To ascertain the Annual Value of property unit the Government of Sindh has rationalized and simplified the system by notifying a valuation table for different localities under Section 5-A of the Sindh Urban Immovable Property Tax Act, 1958. For this purpose, all the Cities (notified as rating areas) of the Province of Sindh have been divided into five Groups and these groups are further bifurcated into four zones according to their socio-economic condition of the localities.

The category wise different rates have been specified for each Zone of every Group, for the size of Plot n sq. Yard and covered area in sq. Feet of the Property Unit.

3- The tax is charged and levied @ 25% of the annual value of the lands and buildings,
4- Determination Of Annual Value
* Size of Plot x Rate x 12.
* Covered Area x Rate x 12.
* Annual Value = (a) Plus (b) Less 10% Allowance for Repair & Maintenance.

The Government on certain Property Units on the basis of their age, location, category and type of construction of the Units also allows the rebates / concessions in Annual Value / Rates.

5- Appeal & Revision:
Any person aggrieved by an order of the appropriate Authority may file Appeal before the Director or Revision Petition before the Director General, Excise and Taxation, Sindh, Karachi within stipulated period as prescribed in the Act, i.e. 30-Days and one year respectively.

6- Definition and duties of the Prescribed Authorities.
* Assessing Authority: - There is an Assessing Authority for every rating area who exercise such powers and performed such duties as or conferred on it by the Act and Rules, i.e. assessment and collection of tax.
* Director: - Perform the duties of collection and appellate authority against any entry in the valuation list or by the insertion there in or omission there from of any matter under Section 10(1-A) of the Act.
* Director General: - To perform the duties of hearing of revision petitions may on own his motion at any time or an application made against the order by an authority sub-ordinate to him.

7- Recovery of Government Dues
All the outstanding dues / penalty against a property unit are revered under Section 16 of the Act, from the owner of the unit but the dues can be recovered from the tenant of such unit under Section 14 of the Act. The tax remaining unpaid is also recoverable under land revenue act.

8- Exemption
1- Under Section 4 of the Sindh Urban Immovable Property Tax Act, 1958 various property units have been exempted from the Property Tax. The tax shall not be leviable in respect of the following properties: -
* building and lands owned by Federal Govt.l Provincial Govt. & Local Govt. for public purpose.

2- A building or land the annual value of which does not exceed eight hundred sixty-four rupees.
3- building used for residential purposes built on a plot nor more than 120 sq.yds.
4- one flat with covered area not exceeding six hundred square feet on any floor of a building used for residential purpose;
5- buildings and lands or portions thereof used exclusively for libraries, public park & play grounds & buildings and lands used exclusively for public worship or public Charity including mosques, churches dharma Salas, gurdawaras, orphanages, alms house burial or burning grounds or other places for the disposal of the dead:
6- buildings and lands the annual value does not exceed 48000/= rupees, owned by widows, minor orphans and permanently disabled persons
7- buildings and lands or portions there of other than commercial properties declared as protected heritage under the Sindh Culture Heritage (Preservation) Act 1994.

After an increase in withholding taxes on buying and selling of immovable properties from July 1, 2023, the Federal Board of Revenue (FBR) would now also raise valuation rates of properties with effect from August 1, 2023.

In this connection, the FBR would complete an exercise in consultation with the provincial authorities by the end of the current month.

Sources informed that the revised rates would be notified by the FBR whereas the number of cities would also be increased from 42 to 51.

Presently, the FBR fixed property valuation rates are applicable in more than 40 cities/ towns of the country including Abbottabad, Attock, Bahawalnagar, Bahawalpur, Chakwal, Dera Ismail Khan, Dera Ghazi Khan, Faisalabad, Ghotki, Gujranwala, Gujrat, Gwadar, Hafizabad, Haripur, Hyderabad, Islamabad, Jhang, Jhelum, Karachi, Kasur, Khushab, Lahore, Larkana, Lasbela, Lodhran, Mandi Bahauddin, Mansehra, Mardan, Mirpurkhas, Multan, Nankana Sahib, Narowal, Peshawar, Quetta, Rahimyar Khan, Rawalpindi, Sahiwal, Sargodha, Sheikhupura, Sialkot, Sukkur and Toba Tek Singh.

Now, the valuation tables of all these cities would be revised upward in the range of 13 to 15 percent, while new nine cities/ towns would be added to the valuation tables’ list with effect from August 1, 2023.

From July 1, 2023, the rates of withholding tax under sections 236C (Advance Tax on sale or transfer of immovable Property) and 236 K (advance tax on purchase or transfer of immovable property) have been increased.

The rate of withholding tax for filers of income tax returns has been increased from 2 percent to 3 percent under section 236 C (Advance Tax on sale or transfer of immovable Property).

The rate of withholding tax for non-filers of income tax returns has been raised from 4 percent to 6 percent under section 236 C (advance tax on sale or transfer of immovable Property).

The rate of withholding tax for filers has been increased from 2 percent to 3 percent under section 236 K (advance tax on purchase or transfer of immovable property).

Details revealed that the rate of withholding tax for non-filers has been further raised from 7 percent to 10.5 percent under section 236 K (advance tax on purchase or transfer of immovable property).

Under the Finance Act 2023, by virtue of amendment made through the Finance Act 2023, changes have been made in the rates of advance income tax collected under sections 236C and 236K of the Income Tax Ordinance 2001.

As per FBR’s field instructions, under section 236(c) of the rate of advance tax would be 3 percent for filers and 6 percent for non-filers.

The new rates under section 236K, the advance tax at the rate of 3 percent would be collected from filers and 10.5 percent from non-filers.
