新北市環保局在去年6月26日於泰山區中港南路與泰林路口稽查時，查獲蔡姓男子貨車上載有民間拆除工程所產生之磚塊、混凝土塊，卻未隨車持有載明產生源及處理地點之證明文件，遂依違反廢棄物清理法裁處6萬元罰鍰，並依環境教育法處環境講習2小時。蔡姓男子提起行政訴訟表示，他是水泥工，所載之物為「可再利用舊有建築材料」，依行政院環境保護署函文解釋，屬於「商品」，而非廢棄物、剩餘土方；另載運磚塊乃是不具污染之資源材料…
