We are pleased to share that yesterday’s high-level webinar on Strategic Extractive Contracts was successfully held.

A sincere thank you to all participants who joined us, and special appreciation to our distinguished panelists — Dr Victoria R Nalule, MCIArb; Dr Carole Nakhle; and Professor Khawar Qureshi — for an engaging and insightful discussion. Drawing from their extensive practical experience, the panel explored the legal and economic implications of extractive contracts, offering valuable perspectives for both policymakers and industry professionals. We also sincerely thank the moderator, Christopher Oyier.

Organised by East Africa Law Society (Official) in partnership with Nalule Energy & Minerals Consultants (NEM Energy) and Crystol Energy, the session provided practical insights into contract structuring, risk allocation, and the evolving role of stabilisation clauses in petroleum and mining agreements.

11/50 – Extractive Negotiation Series with Dr Victoria R Nalule, MCIArb

NEGOTIATING PRACTICAL ENERGY PROGRESSION PATHWAYS

Energy progression is essential for safeguarding economic development while enabling long-term decarbonization. For developing economies, transition commitments that are not carefully negotiated can undermine infrastructure development, strain fiscal capacity, and threaten energy security.

Effective energy transition frameworks require phased, negotiated pathways that reflect national circumstances. A one-size-fits-all approach risks weakening development objectives and long-term policy credibility.

Through strategic negotiation, governments and institutions can design balanced energy progression pathways that protect national interests, support investment stability, and align with global climate commitments.

With over a decade of experience in energy, mining, and extractive sector governance, and as the author of 10+ natural resources books, numerous publications and policy engagements, Dr Victoria R Nalule, MCIArb, through Nalule Energy & Minerals Consultants (NEM Energy), provides governments, regulators, and international institutions with specialised advisory services including:

1. Strategic negotiation support for extractive sector agreements
2. Energy and mining contract design and review
3. Climate and energy policy advisory
4. Dispute prevention and risk management in natural resource projects

Strong laws, stronger state negotiating power

Clear, predictable legislation and regulatory frameworks enhance a government’s leverage in extractive resource negotiations. States must avoid agreements that deliver marginal returns or limit future policy options.

Successful negotiation hinges on robust legal & institutional frameworks and fair, transparent contractual terms.

5/50 – Extractive Negotiation Series with Dr Victoria R Nalule, MCIArb

Clean energy requires negotiated mineral value chains

The energy transition depends on critical minerals. However, when mining operations rely on high-emission energy sources, the integrity of that transition is undermined.

Governments and institutions must therefore negotiate mineral value chains, including their energy inputs in a coherent, climate-aligned, and commercially sound manner. This requires integrated strategies that address extraction, processing, energy sourcing, infrastructure, and long-term value creation.

With over a decade of experience, more than ten published books, and extensive policy engagement, Dr Victoria R Nalule, MCIArb through Nalule Energy & Minerals Consultants (NEM Energy), provides specialist advisory services to governments, state agencies, and international organisations in:

*Extractive and natural resource contract negotiations
* Critical minerals and energy transition strategy
* Dispute avoidance and dispute resolution
* Regulatory and institutional framework development
* Resource governance and policy advisory

For governments and organisations seeking structured, strategic, and climate-coherent extractive negotiation support, we welcome consultancy engagements and advisory partnerships.

Shifting the Balance in Critical Minerals Supply Chains.

The U.S. is moving to reshape the critical minerals landscape, proposing a new trading bloc and coordinated pricing floors to counter China’s dominance in rare earths.

Recent trade tensions have exposed how vulnerable global supply chains are to concentrated control—making diversification a strategic priority.

How effective do you think this approach will be in strengthening global supply chain resilience?

1/10 – Continental Impact & Thought Leadership | NEM Energy 🌍

In 2025, Nalule Energy & Minerals Consultants (NEM Energy)was proud to contribute expert insight to the Africa Governance Report 2025 (AGR25), officially launched in August by the African Peer Review Mechanism (APRM)—an institution of the African Union. The report addresses critical governance and policy challenges within Africa’s natural resources sector.

We are especially honoured that a concept developed by NEM Energy was formally adopted in AGR25: Energy Progression—a strategic, realistic, and scalable framework for addressing Africa’s complex energy challenges while balancing development, sustainability, and governance priorities.

To further explore this milestone, we recorded a video explaining what Energy Progression means in practice and how it could shape Africa’s energy landscape for decades to come:

This contribution reflects the impact and credibility of our work at NEM Energy. Our team of globally recognised energy and mining experts has collectively authored over 100 leading books and has worked on major energy, mining, and natural resource projects across Africa and around the world. This depth of global experience positions NEM Energy as a trusted adviser to governments, corporations, and organisations navigating complex energy transitions.

A big thank you to the brilliant minds who contributed to this report, and to the visionary leadership of Dr McBride P. Nkhalamba, Karabo Mochebelele (Née Chadzingwa) and the entire APRM team. Your work is setting the stage for real impact.
