Help Needed Immediately
The Florida construction industry is under attack!
H.B. 893 will eliminate your lien rights.

The language in HB.893 proposes to eliminate your legal right to lien the majority of construction projects.

The construction industry needs your help more than ever.

Subcontractors and suppliers are facing a new challenge from anti-construction members of the Florida House of Representatives. Our industry is under attack. Representative Overdorf and others are against the timely and prompt payment to subcontracts by general contractors and have proposed eliminating your lien rights.

Florida’s construction lien law has been in place for close to 100 years. In its present form, our lien law protects not only owners and contractors, but also protects subcontractors, suppliers and design professionals by protecting their right to prompt payment for their labor, services and materials on construction projects.

This proposed bill states:

“…a person may not have a lien on the real property improved if the contractor received payment in full for all moneys owed to date under the direct contract”.

If you are a Subcontractor or supplier, read that sentence carefully…

• A Contractor is no longer required to pay you or obtain a final release from you. Your lien and/or right to lien becomes null and void.
• This bill opens the opportunity for unscrupulous owners and contractors to take advantage of small laborers and businesses without paying for their hard work and materials which built the project.
• Without the existing lien law protections, subcontractors and suppliers will flood county and civil court systems with collection litigation at every level, from small claims court to the highest level civil courts. YOUR ONLY RECOURSE IS TO SUE THE CONTRACTOR.

It is critical that we mobilize now!
