For the third time in as many years, extended producer responsibility (EPR) legislation in New York was on the table, but ultimately was not passed, as the 2026 legislative session ended without a final vote on the Packaging Reduction and Recycling Infrastructure Act.

The bill would require producers to cover the cost of managing post-consumer packaging waste, a cost currently absorbed by local governments and taxpayers, establishing a statewide EPR program for producers with more than $5 million in annual net revenue responsible for more than 2 tons of annual packaging waste.

In SmartLifeco’s October 2025 survey of 1,000 American adults, sustainability emerged as a defining force in how people shop. From Gen Z refusing brands with excessive plastic packaging to high-income earners reshaping their buying habits, consumers across age and income groups are rethinking their purchases.

In the survey, 53% of Gen Z respondents said they have stopped purchasing a product or brand because of excessive plastic packaging. This shift highlights how seriously younger consumers take environmental impact and how closely they watch brand behavior.
