For remediation teams working on legacy industrial sites, cultural resources due diligence can help prevent costly delays and regulatory uncertainty.

ESE Partners recently completed a cultural resources survey for a former specialty metals site in Muskogee, Oklahoma, supporting planned remediation in a complex industrial and regulatory environment.

The project involved contaminated and disturbed soils, radioactive materials, limited surface visibility, historic-age structures, and challenging field conditions.

ESE conducted archival research, pedestrian survey, shovel testing, GPS documentation, and historic structure documentation, while adapting field decisions to site conditions, safety requirements, and consultation input.

The result? No archaeological sites were identified within the proposed remediation areas, supporting the conclusion that significant cultural resources were unlikely to be affected by the planned work.

Emergency response cleanup is not just about speed. For industrial, utility, and remediation teams working in sensitive waterways, it is also about maintaining compliance while protecting cultural resources in the field.

ESE Partners recently supported an emergency environmental cleanup along a 44-mile contaminated river corridor in southeastern Louisiana following an industrial fire.

The project required cultural resources monitoring under complex response conditions involving CERCLA, the Clean Water Act, and Section 106 of the National Historic Preservation Act. ESE conducted a cultural resources records review, revisited previously documented archaeological sites, monitored ground-disturbing activities, and documented newly identified prehistoric and historic resources within the area of potential effects.

By the end of the monitoring effort, ESE had revisited 11 previously recorded sites and documented 3 new archaeological resources. Based on the Phase I survey and monitoring findings, no significant cultural resources were determined to have been impacted by cleanup activities.

The project demonstrates why cultural resources compliance cannot be an afterthought during emergency response. When monitoring is integrated into field operations from the start, teams can keep cleanup moving while protecting sensitive resources and demonstrating regulatory due diligence.

The 2026 Texas MSGP renewal period is underway.

Existing permittees now have until November 12, 2026 to complete the renewal process for the TPDES Multi-Sector General Permit (TXR050000).

For facilities operating under the MSGP, renewal is a good opportunity to make sure current permit documentation still reflects actual site conditions.

Before submitting your renewal, consider reviewing:

- Industrial activities and SIC codes
- Your Stormwater Pollution Prevention Plan (SWP3)
- Drainage areas and stormwater outfalls
- Stormwater controls and BMPs
- Changes to facility operations since the last permit term

A lot can change over five years. Identifying those changes now can help facilities address potential compliance gaps before the renewal period closes.

A data center site can have the power, fiber connectivity, and location a developer needs and still present environmental challenges that significantly affect the project.

Because data center development moves on compressed timelines, identifying those challenges early can make a meaningful difference. Environmental constraints discovered during site selection may influence the feasibility of a property, the design of a project, permitting requirements, construction schedules, and ultimately the cost of development.
