Does Texas Still Require City Food Truck Permits in 2026? Here's What Changed.
If you ownโor are planning to startโa food truck, concession trailer, coffee trailer, BBQ trailer, taco truck, or other mobile food business in Texas, this is one of the biggest regulatory changes in years.
Effective July 1, 2026, House Bill 2844 (HB 2844) changed how eligible Mobile Food Vendors (MFVs) are licensed in Texas.
What changed?
Instead of obtaining separate health permits from multiple cities or counties, eligible mobile food vendors now apply for one statewide Mobile Food Vendor License through the Texas Department of State Health Services (DSHS).
Does that mean local requirements are gone?
No.
The statewide DSHS license replaces many local health permits, but it does not eliminate local regulations.
For example, if you operate within the City of El Paso, the Fire Marshal's Office still requires an Annual Fire License Inspection (LFIR) for food trucks with commercial cooking equipment that produces smoke or grease-laden vapors. Local parking, zoning, fire safety, and other municipal regulations also remain in effect.
What this means for food truck owners
โ One statewide DSHS health license for eligible mobile food vendors.
โ No more applying for multiple city health permits across Texas.
โ You must still comply with local Fire Marshal inspections and city ordinances where you operate.
Our recommendation
If you're building or remodeling a food truck, don't focus only on the state license. Make sure your mobile kitchen is designed to satisfy both the Texas Department of State Health Services (DSHS) requirements and your local Fire Marshal's inspection standards before scheduling your opening.
We've seen projects delayed because of preventable issues involving hood systems, fire suppression, propane installation, ventilation, and electrical compliance. Addressing these items during the build is far easier than making corrections after an inspection.
