The HPPA was designed to stop unauthorized sale or use of a homebuyer’s credit information, especially after a mortgage credit report is pulled. It addresses consumer complaints about being bombarded with calls and mailers from other lenders immediately after applying for a mortgage.
🔐 Key Provisions
Ban on “Trigger Leads” (with limited exceptions)
Credit bureaus used to sell “trigger leads” — alerts that someone applied for a mortgage — to other lenders and lead companies.
Under the HPPA, trigger leads can no longer be sold or shared unless the consumer has given explicit written consent.
Enhanced Consumer Consent
Lenders must obtain clear, written authorization before sharing or using a buyer’s personal financial information for marketing or cross-selling.
Penalties for Violations
Companies that buy or sell trigger leads without proper consent face civil penalties and enforcement actions by the Consumer Financial Protection Bureau (CFPB) and Federal Trade Commission (FTC).
Consumer Rights
Borrowers can opt out of sharing or marketing uses of their data.
They also gain stronger recourse to file complaints or civil actions if their information is misused.
🏠 Practical Impact for Loan Officers & Lenders
You can still pull credit and share information within your own organization for legitimate loan processing.
However, you cannot buy leads generated from someone else’s mortgage credit pull unless they’ve given written consent.
Marketing departments and lead vendors must review compliance policies to ensure no data from credit bureaus is used unlawfully.
