The passage of the New Government Procurement Act (NGPA) or Republic Act No. 12009 and its Implementing Rules and Regulations (IRR) establishes Section 37 as a new mode of Direct Procurement for Science, Technology and Innovation. This provision introduces a fit-for-purpose approach that allows Procuring Entity (PE) to directly obtain goods or services from a legally, technically and financially capable manufacturer, supplier, or qualified startup business for the following:

a) Supplies, materials, equipment, and related services to be used actually, exclusively, and directly in the conduct of research and development (R&D) projects or activities;

b) Goods which include products of a commissioned task by a PE which were processed, developed, and manufactured in satisfaction of its needs and requirements. These include: (1) pre-commercial goods and services that involve early market engagement to stimulate the development of new goods and services that meet specific government needs; and (2) goods to be manufactured by qualified startup businesses alongside the thrust to develop and support new and startup businesses.

Unless otherwise indicated in a written agreement, the intellectual property rights and ownership over the commissioned goods developed and manufactured pursuant to this provision shall belong to the PE, and no manufacturing or sale thereof can be performed by the supplier; and

c) Other goods analogous to the foregoing.

Approved on January 15, 2026, and published on March 20, 2026, this strengthened procurement policy was developed by the Government Procurement Policy Board (GPPB), in coordination with the National Innovation Council (NIC), to bolster the countryโ€™s research, development, innovation, and enterprise ecosystem.

The published guidelines for implementing NGPA Section 37 showcase an innovative procurement approach that reinforces government's commitment to advancing national innovation goals and priorities. It enhances efficiency by supporting the timely delivery of government programs and projects while fostering innovation through early market engagement and support for startups.

๐‹๐Ž๐Ž๐Š: During its 9th meeting, the National Innovation Council (NIC), presided over by President Ferdinand R. Marcos Jr., endorsed the issuance of the Supplemental Guidelines for Direct Procurement for Science, Technology, and Innovation pursuant to Section 37 of the Implementing Rules and Regulations of the New Government Procurement Act (RA No. 12009).

โ€œTo keep pace with global technological developments and foster a dynamic innovation ecosystem, government procurement must be fast, flexible, and open to new ideas. This new modality under the New Government Procurement Act accelerates research, encourages early commercialization of innovations, and gives startups and new technology suppliers a real opportunity to contribute and compete,โ€ said DEPDev Secretary Arsenio M. Balisacan, NIC Vice Chairperson.

The NIC also reviewed DEPDevโ€™s Policy Reform Study on โ€œStreamlining Business Registration, Renewal, and Exit Processes,โ€ which addresses the administrative challenges faced by business enterprises, especially micro, small, and medium enterprises and startups, in starting, maintaining, and closing their businesses.

The FILARB Team is beyond grateful to be one of the Finalists of the 1st Presidential Filipinnovation Awards!

The mentoring, coaching, support, and connections provided and made all through out the journey helped us a lot to promote our advocacy, mission, and most particularly our flagship technology, the Oil-Based Thermal Disinfection (OBTD) Technology.

Fifteen (15) finalists across NCR, Luzon, Visayas, and Mindanao presented & pitched their respective innovation at the National Competition of the 1st Presidential Filipinnovation Awards which was held on Nov 2-7, 2025 at the Crowne Plaza Hotel Manila Galleria, Quezon City. Out of the 15, five (5) finalists were selected and recognized as the Presidential Filipinnovation Awardees of the Year: Pili Seal, Rezbin, Palatak Palay Seeder, Ediphi, Bambujett.

The Presidential Filipinnovation Awards, led by the National Innovation Council (NIC) and Department of Economy, Planning, and Development (DEPDev, formerly NEDA), was officially institutionalized as the countryโ€™s premier and most prestigious innovation recognition program through the Executive Order No. 99 signed by President Ferdinand R. Marcos, Jr. on October 6, 2025. Itโ€™s a yearly nationwide competition that showcases Filipino Innovators.
