Under 34 TAC 3.295, a nonresidential lessor is the consumer for sales tax purposes and cannot claim exemption based on a tenant's exempt status. So an IRS determination letter from a clinic in leased space does not make the electricity at that ESI ID exempt, no matter how good the letter is. Texas presumes electricity sales are taxable. Exemption runs through predominant use established over 12 consecutive months on a single meter, a study kept at the location, and a certificate given to the provider. Brokers: put legal purchaser, lease structure, study status, and certificate date in the intake fields, and label the tax line verified, pending, or assumed.

A Texas fixed-rate plan must run at least three months and hold the same price every billing period, with only four permitted exceptions written into 16 TAC 25.475. That is a rule, not a marketing claim, and it is why fixed, variable, and indexed are not three brand names for the same product. A residential variable plan can only be month-to-month. An indexed plan follows a formula disclosed before you sign. The Electricity Facts Label is where the category is stated, and the June 2026 preliminary order in PUCT Docket 58631 shows the Commission takes the fixed-versus-variable characterization seriously enough to litigate it. ERCOT's West zone averaged $41.59/MWh in 2025 against a systemwide $36.94, per the Independent Market Monitor's State of the Market Report. That $4.65 spread is exactly what an index buyer absorbs and a fixed buyer pays a premium to avoid. Contract structure doesn't remove market risk from a commercial deal. It decides who holds congestion, losses, unaccounted-for energy, and ancillary services, and the contract language is where that gets settled. One thing worth checking today: after RTC+B went live in December 2025, any index illustration still showing a standalone ORDC adder is describing a market that stopped running that way.
