🏡 A new financing opportunity for build-to-rent communities is here. What does it mean for developers?

The U.S. Department of Housing and Urban Development (HUD) has issued Mortgagee Letter 2026-12, expanding access to FHA-insured financing for qualifying build-to-rent (BTR) communities.

This update creates another potential financing pathway while emphasizing the importance of aligning financing, design, and construction planning from the start.

Here are five things developers should know:

1. Two financing programs are available.
▪️ Section 221(d)(4): For new construction.
▪️ Section 223(f): For acquisition or refinancing of recently developed properties with a certificate of occupancy dated less than three years before application.

2. Eligibility matters.
Qualifying communities generally need at least five dwelling units on one contiguous site, professional management, and unified operation as a single rental property.

3. Accessibility remains essential.
Requirements for common-use areas and usable doors still apply. Addressing accessibility during design can help minimize costly revisions and delays.

4. Underwriting requires careful planning.
Operating expenses, maintenance, replacement reserves, and lease-up schedules all factor into evaluating a BTR project.

5. Long-term strategy is key.
HUD generally prohibits individual home sales and partial collateral releases during the insured loan term. Section 223(f)'s three-year property-age limit also makes timing critical.
